Terms & Conditions

These terms set out the basis on which Sirih Adil offers its services. We ask that you read them with care before engaging us.

1. About Sirih Adil

Sirih Adil is a legal firm registered in Malaysia and operating from Wisma Permata, Jalan Tun Perak, 50050 Kuala Lumpur. We focus on pension protection matters for Malaysian retirees, civil servants, and their families. Our work is governed by the Legal Profession Act 1976 and the professional rules of the Malaysian Bar.

By contacting us, making an enquiry, or engaging our services, you agree to these terms. If any part of these terms is unclear, we welcome your questions before engagement commences.


2. The Services We Offer

Our current service offerings are as follows:

  • Spousal Pension Briefing (RM 360) — A joint consultation for couples approaching retirement, covering the interaction of their pensions, EPF accounts, and survivor benefits under Malaysian law, accompanied by a written summary.
  • Civil Servant Pension Recalculation (RM 730) — Legal work to examine whether a retired civil servant's pension has been calculated correctly, including service record review, correspondence with JPA, and preparation of a written request for review where the records support one.
  • End-of-Life Pension and Legacy File (RM 985) — A comprehensive engagement to bring together a client's pension records, will, EPF nominations, advance health-care preferences, and family memoranda into a single ordered file. The firm holds the original; duplicate copies are provided to a nominated family member.

The scope of each service is set out in the engagement letter provided before work commences. Services are provided only to clients in Malaysia. We reserve the right to decline an engagement where it falls outside our area of practice or where a conflict of interest exists.


3. How We Engage

An engagement formally begins when you have received and acknowledged our engagement letter and we have received the agreed fee or deposit. No work is commenced before both conditions are satisfied.

All significant decisions during the engagement will be shared with you before we proceed. We will not escalate a matter — for example, by writing to JPA — without first consulting you and confirming that this is your wish. Time and cost implications of any escalation will be discussed openly.

The End-of-Life Pension and Legacy File engagement is designed to proceed at whatever pace suits your circumstances. The work may pause and resume at your direction. We will not apply pressure to continue at a pace that does not suit you.


4. Fees and Payment

Our fees for each service are those listed on this website and confirmed in the engagement letter. All fees are quoted inclusive of applicable taxes unless stated otherwise.

4.1 Payment terms

Full payment for the Spousal Pension Briefing and Civil Servant Pension Recalculation is due before work commences. For the End-of-Life Pension and Legacy File, a deposit of RM 400 is payable on engagement; the balance falls due on completion of the initial file assembly, at a point confirmed in writing to you.

4.2 Methods of payment

We accept payment by bank transfer to our designated client account. Details are provided in the engagement letter. We do not accept cash for fees above RM 200.

4.3 Disbursements

Where the conduct of your matter requires us to incur disbursements — for example, fees for obtaining official records — these will be discussed and agreed with you in advance. They are not included in the quoted service fee unless specifically stated.

4.4 Refunds

If you choose to discontinue an engagement before it is completed, we will refund any portion of the fee that corresponds to work not yet undertaken, less a reasonable administrative charge. The amount will be calculated fairly and explained to you in writing.


5. Your Responsibilities

The quality and pace of our work depends in part on your cooperation. We ask that you:

  • Provide us with accurate and complete information relevant to your matter.
  • Inform us promptly if any information you have provided changes.
  • Respond to our communications within a reasonable time when a response is needed.
  • Provide documents and records in your possession that we indicate are relevant to your matter.
  • Not misrepresent facts to third parties such as JPA in connection with matters we are handling on your behalf.

We cannot be responsible for outcomes that arise from inaccurate information provided by you or from documents withheld from us.


6. Confidentiality

All information you share with us is held in strict confidence. We will not disclose your information to third parties except where:

  • You have given us your express written consent to do so;
  • Disclosure is necessary to conduct your matter — for example, corresponding with JPA on your behalf;
  • We are required to do so by law or by order of a court; or
  • Disclosure is necessary to prevent or detect a serious crime.

Our duty of confidentiality continues after the engagement has ended. Files are retained for a minimum of seven years from the date of closing, after which they may be destroyed unless you request otherwise in writing.


7. Personal Data

We handle personal data in accordance with Malaysia's Personal Data Protection Act 2010 (PDPA). Full details of how we collect, use, store, and protect your personal data are set out in our Privacy Policy, which forms part of these terms.

By engaging our services, you acknowledge that we may process your personal data — including sensitive personal data such as health information, where relevant to the End-of-Life Pension and Legacy File — to the extent necessary to perform the services.


8. Intellectual Property

The written summaries, letters, and other documents we prepare for you in the course of an engagement are provided for your use in connection with your personal matter. You may share them with family members or relevant government bodies as needed.

The content of this website — including text, design, and structure — belongs to Sirih Adil and may not be reproduced without our written consent.


9. Limitation of Liability

We take our work seriously and aim to provide careful, considered legal assistance. However, we must set out certain limitations honestly.

We do not accept liability for outcomes that depend on decisions made by third parties — including JPA, EPF, or other government bodies — who are outside our control. Our work is to prepare and present the strongest case the records support; the decision rests with those bodies.

Where our own negligence or breach of duty causes you a loss, our liability is limited to the fee paid for the relevant service. Nothing in these terms limits our liability for fraud, or where limitation is not permitted by Malaysian law.

We carry professional indemnity insurance as required by the Malaysian Bar.


10. Ending the Engagement

10.1 By you

You may end the engagement at any time by written notice to us. We will promptly return all documents you have provided and advise you of the stage reached. A statement of fees incurred to the date of termination will be issued, and any balance owing to you will be refunded in accordance with Section 4.4.

10.2 By us

We may end the engagement in limited circumstances — for example, if you ask us to act in a manner inconsistent with our professional obligations, if accurate instructions cannot be obtained, or if the fee has not been paid after reasonable notice. We will give you sufficient notice to arrange alternative representation and will not withdraw in a manner that prejudices your interests.


11. Complaints

If at any point you are dissatisfied with our work or our conduct, we ask that you raise the matter with us first. We take complaints seriously and will respond within ten business days with a substantive reply or a timeline for resolution.

If we are unable to resolve your complaint to your satisfaction, you have the right to refer the matter to the Advocates and Solicitors Disciplinary Board or the Bar Council of Malaysia. We will not penalise you for making a complaint in good faith.


12. Governing Law

These terms are governed by and interpreted in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these terms or the services provided by Sirih Adil shall be subject to the exclusive jurisdiction of the courts of Malaysia.


13. Changes to These Terms

We may update these terms from time to time to reflect changes in our practice, fees, or applicable law. The version in force at the time you engage us is the version that governs your engagement. We will not alter the terms of an ongoing engagement without your consent.
